Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Tabbify platform, websites, APIs, command-line tools and related services (together, the “Service”), operated by Leontii Snegirev PR Računarsko programiranje Beograd-Stari Grad (“Tabbify”, “we”, “us”), based in the Republic of Serbia. By creating an account, placing an order, or using the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation.

1. The Service

Tabbify is a distributed cloud platform. It builds, deploys, hosts, and helps maintain software for you — from a single command for technical teams to plain-language requests handled by an AI agent for everyone else. The Service includes compute (containers and virtual machines), deployment and hosting, managed open-source and third-party services, storage and networking over a private mesh network.

2. Accounts and eligibility

You must be at least 18 years old and able to enter into a binding contract. You are responsible for your account credentials and for all activity under your account. Keep your credentials confidential and notify us promptly of any unauthorised use at support@tabbify.io.

3. Acceptable use

You agree not to use the Service to:

• break any applicable law or infringe anyone’s rights, including intellectual property;
• host or distribute malware, run denial-of-service attacks, or attempt to breach the security of the Service or others;
• send unsolicited bulk messages (spam) or engage in fraud or deceptive practices;
• mine cryptocurrency or run workloads that abuse shared resources, except where we expressly allow it in writing;
• resell or expose the Service in a way that materially degrades it for other customers.

You are solely responsible for the content, code and data you run on the Service (“Your Content”) and for having the rights to use it.

4. Payments, billing and taxes

Our order process and online payments are conducted by our reseller and Merchant of Record, Paddle.com Market Ltd (“Paddle”). Paddle is the merchant of record for all orders placed through the Service and handles the transaction, invoicing and taxes. Your purchase is therefore also subject to Paddle’s Buyer Terms and Conditions.

• Subscriptions (for example the Base plan) are billed in advance on a recurring basis and renew automatically until cancelled.
• On-demand compute, storage and transfer are metered by usage and billed in arrears for the period in which they were consumed.
• Prices are shown in USD and exclude VAT or sales tax, which is added at checkout based on your location.
• We may change prices; changes to recurring fees take effect at your next renewal and we will give reasonable notice.

Refunds are handled as described in our Refund Policy.

5. Free tier

We may offer a free tier with limited resources for evaluation. The free tier is provided “as is”, may be subject to quotas and rate limits, and may be changed, throttled or discontinued at any time.

6. Managed and third-party services

The Service lets you connect to ready open-source systems and third-party or commercial services, sometimes with licences included in your price. Your use of those services may be subject to the relevant third party’s or open-source project’s own terms and licences, and you agree to comply with them.

7. Intellectual property

We own the Service and all related intellectual property. You own Your Content. You grant us a limited licence to host, process and transmit Your Content solely to provide and maintain the Service. We grant you a non-exclusive, non-transferable right to use the Service during your subscription.

8. Data protection

Our handling of personal data is described in our Privacy Policy. A core principle of the Service is keeping your data within the jurisdiction you choose, and offering self-hosting where required.

9. Availability and support

We work to keep the Service available, but the free and Base plans are provided on a best-effort basis without a guaranteed service level. Formal availability guarantees (SLA) are offered on Business plans. We may perform maintenance and will aim to give reasonable notice of planned downtime.

10. Suspension and termination

You may cancel at any time from your account or by contacting us. We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the Service in a way that harms the platform or others. On termination, your right to use the Service ends; we will make Your Content available for export for a reasonable period where practicable, after which it may be deleted.

11. Disclaimers

The Service is provided “as is” and “as available” to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose. You are responsible for maintaining your own backups of critical data unless a specific reliability level is purchased.

12. Limitation of liability

To the maximum extent permitted by law, Tabbify will not be liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability arising out of or relating to the Service in any 12-month period is limited to the amounts you paid for the Service in that period.

13. Indemnity

You agree to indemnify and hold Tabbify harmless from claims arising out of Your Content or your breach of these Terms or of applicable law.

14. Governing law

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-laws rules. The courts of the Republic of Serbia have jurisdiction, without prejudice to any mandatory consumer-protection rights you have in your country of residence.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you by a reasonable means. Your continued use of the Service after changes take effect constitutes acceptance.
